Boards of Adjustment were created to provide a means to deal with unanticipated hardships as they arise with issues of zoning. In general, a Board of Adjustment is a quasi-judicial, not a policy-making body. The Board interprets the meaning and spirit of the zoning ordinance as enacted by the governing body by hearing and deciding on variance applications when they arise. It does not have the authority to make law or change zoning law. The Board meets when applications for variances or appeals occur and is not expected to meet regularly as some other Town Boards, Commissions and Committees do.
The Special Training meetings may be held once the board is formed to provide adequate knowledge for the board to perform this function. Town Code Section 153.021 outlines the structure, the powers and duties of the Board of Adjustment. Town Council has been performing the duties of the Board of Adjustment since 2012. Ideally, the Council would like to appoint a 5-person volunteer board to serve as the Board of Adjustment.
If you are interested in serving in this capacity, please contact town hall at (928)632-7362 and complete an application for this board. Town Clerk Judy Morgan, Town Planner Steven Brown, or Town Manager Yvonne Kimball can help you if you have any questions about serving on the Board of Adjustment.
